These Terms and Conditions ("Terms") govern your use of the website located at oakdaledeckandfence.com (the "Site"), operated by Master Oakdale Deck & Fence ("we," "us," or "our"), a contractor based in Oakdale, CA.
By accessing or using the Site, or by hiring us for any service, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, please do not use the Site or engage our services.
Master Oakdale Deck & Fence provides residential deck building, fence installation, and related outdoor construction services in Oakdale, CA and the surrounding service area. The Site is used to provide information about these services and to allow potential customers to request estimates or contact us.
All services are provided subject to a separate written contract or work agreement signed by both parties before work begins. Information on the Site does not constitute an offer or a binding commitment to provide any specific service at any particular price.
On-site estimates are provided free of charge and are based on conditions observed at the time of the visit. Written estimates are valid for 30 days from the date issued unless otherwise stated in writing. Prices may change if site conditions, material costs, or the scope of work change after the estimate is given.
An estimate is not a final price or a contract. Work begins only after a written agreement is signed by both the customer and Master Oakdale Deck & Fence. Any scope changes or additions requested after signing will be documented in a written change order and may affect the total cost and timeline.
We do not guarantee that the cost of any project will match prices found on general cost guides or national averages. Actual pricing depends on local labor, materials, permit fees, and site-specific conditions.
Project start dates are scheduled after a contract is signed and any required deposit is received. Project timelines are estimates and may be affected by weather, permit processing times, material availability, or factors outside our control. We will communicate any material delays as promptly as possible.
If you need to cancel or reschedule a project after a contract is signed, please notify us in writing as early as possible. Cancellation terms, including any deposit refund or retention policy, are specified in your individual project contract.
We reserve the right to reschedule or suspend work due to unsafe weather conditions, permit issues, or circumstances beyond our reasonable control, without liability to the customer.
Payment schedules and accepted payment methods are set out in your individual project contract. A deposit is typically required before work begins. Final payment is due upon project completion and the customer's acceptance of the finished work, unless otherwise agreed in writing.
Overdue balances may be subject to late fees as specified in your project contract. We reserve the right to suspend work on any project where a scheduled payment has not been received.
All prices are stated in U.S. dollars. Taxes, permit fees, and any governmental charges are the responsibility of the customer and will be itemized in the project contract where applicable.
For projects requiring a building permit, Master Oakdale Deck & Fence will apply for and manage the permit process on the customer's behalf, unless otherwise agreed in the project contract. Permit fees are passed through to the customer and will be itemized in the estimate or contract.
Work is performed in accordance with applicable California building codes and local regulations. The customer is responsible for disclosing any HOA rules, deed restrictions, or easements that may affect the project before work begins.
To the fullest extent permitted by applicable law, Master Oakdale Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any services we provide, including but not limited to loss of use, loss of revenue, or property damage not directly caused by our work.
Our total liability for any claim arising out of a project or the Site shall not exceed the total amount paid by the customer for the specific project giving rise to the claim. Nothing in these Terms limits our liability where such limitation is prohibited by applicable law.
The Site and the information on it are provided "as is" without any warranty of any kind, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be free of errors, uninterrupted, or free of viruses or other harmful components.
Warranties for physical work performed by Master Oakdale Deck & Fence are set out in your individual project contract. Material warranties are governed by the terms of the applicable manufacturer warranties and are not independently guaranteed by us beyond what is stated in writing.
If a dispute arises between you and Master Oakdale Deck & Fence, we encourage you to contact us directly first so we can try to resolve it informally. Please reach out by phone or email using the contact information below.
If informal resolution is not possible, any dispute arising from these Terms or from a project we performed shall be resolved by binding arbitration conducted in Stanislaus County, California, in accordance with applicable arbitration rules, unless both parties agree in writing to a different method. Each party is responsible for its own legal fees unless applicable law provides otherwise.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to your use of the Site or any services provided by Master Oakdale Deck & Fence that is not subject to arbitration shall be brought exclusively in the courts located in Stanislaus County, California.
We may update these Terms at any time by posting a revised version on this page. The revised Terms will take effect when posted, and the "Last updated" date at the top of this page will reflect when changes were made. Continuing to use the Site or our services after a revision is posted means you accept the updated Terms. We encourage you to review this page periodically.
